Terms of Use

These terms are an agreement between you and Eternal Swell LLC ("we", "us") covering your use of A Cool Journal. By using the app, you agree to them. If you do not, please do not use the app.

This is not therapy or medical care

Read this part even if you skip the rest.

A Cool Journal is a tool for reflective writing. It is not therapy, counselling, medical or mental-health advice, diagnosis, or treatment, and it is not a crisis service. The coach is software. It is not a licensed professional, it does not know you the way a person would, and it can be wrong.

Do not rely on it in an emergency. If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis line immediately. In the United States, you can call or text 988 to reach the Suicide and Crisis Lifeline.

Nothing the app produces should replace advice from a qualified professional. If something you write about is affecting your health or safety, please talk to someone who can actually help.

Who can use it

You must be at least 16 to use A Cool Journal. If you are under the age of majority where you live, you need a parent or guardian's permission.

Your account

You are responsible for what happens under your account and for keeping access to it secure. An account is created with a name, and optionally an email address so you can get back in later. If you do not add an email address, we may have no way to restore access if you lose your device — please keep that in mind.

Your writing belongs to you

You own everything you write. We do not claim ownership of your entries, your conversations, or your photos.

To operate the service, you give us a limited licence to store, process, and display your content back to you, and to send it to our AI provider so the coach can reply. That licence exists only to make the app work. It is not a licence to publish your writing, show it to anyone else, use it in marketing, or use it to train models. It ends when you delete the content or your account. How your writing is handled is described in the Privacy Policy.

Using the app reasonably

Please do not: break the law with it; try to break into it, disrupt it, or access other people's data; scrape it or resell access to it; use it to generate content that harms other people; or attempt to reverse-engineer it beyond what the law allows you to do regardless of this clause.

Fair use of the coach

Every coach reply costs us money to generate, so access is generous but not literally without limit. We may set reasonable limits on how much of the coach you can use, and we may slow down, suspend, or close an account whose usage falls well outside normal personal journaling — including automated or scripted access, bulk use, or reselling access to other people.

These limits are set so that ordinary use never reaches them. They exist to stop abuse, not to ration the product.

What the coach produces

Coach replies are generated by an AI model. They may be inaccurate, may misread what you meant, and may occasionally say something unhelpful. Treat them as prompts for your own thinking, not as guidance to act on. You are responsible for decisions you make.

Availability and changes

We are a small operation. The app may be unavailable at times, features may change, and we may add or remove them. We will avoid destroying your writing in the process, but we do not guarantee uninterrupted service. Keep your own copies of anything you cannot afford to lose.

Payment

A Cool Journal is free to download and use — journaling, check-ins, and search cost nothing. The AI coach is unlocked through a subscription: a monthly plan ($9.99/month) or an annual plan ($79.99/year), each starting with a 7-day free trial.

Subscriptions automatically renew at the end of the trial and at the end of each billing period, at the price above, unless you cancel at least 24 hours before the renewal date. You can cancel anytime in your device's App Store settings (on iOS: Settings → your name → Subscriptions). Cancelling stops future renewals; you keep access through the end of the period you already paid for.

Purchases are made through the App Store and are also governed by Apple's terms. Apple, not us, processes your payment and handles billing. Refunds are handled by Apple through the App Store, not by us.

Ending things

You can stop using A Cool Journal at any time and delete your account from Settings, which removes your data as described in the Privacy Policy. We may suspend or close an account that breaks these terms or puts the service or its users at risk.

Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be error-free, that it will meet your needs, or that anything the coach says will be accurate or useful.

Limitation of liability

To the maximum extent permitted by applicable law, Eternal Swell LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of A Cool Journal.

Governing law and disputes

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. You and Eternal Swell LLC agree to the exclusive jurisdiction of the state and federal courts located in King County, Washington.

Changes to these terms

If we change these terms we will update the date at the top, and we will give notice in the app before a material change takes effect. Continuing to use the app after that means you accept the new terms.
